PREAMBLE

 

We, the members of the ROCK HILL MISSIONARY BAPTIST CHURCH of Belews Creek, North Carolina, declares and establish this Constitution to preserve and secure our "FAITH" and to govern the Church body in an orderly manner. This Constitution will preserve the liberties of each individual Church member and the freedom of action of this body in relation to other Churches.

ARTICLE I

 

NAME OF CHURCH

 

This body shall be known as the ROCK HILL MISSIONARY BAPTIST CHURCH.

ARTICLE II

 

PURPOSE

 

The ROCK HILL MISSIONARY BAPTIST CHURCH is organized for the purpose of advancing and promoting the worship of God through:

1. Reading and studying the Holy Bible as the revealed Word of God.

2. Preaching and teaching the Gospel of our Lord and Savior, Jesus Christ.

3. Conducting all types of worship services for the spiritual training, development, and benefits of each member and for the winning of souls to Jesus Christ.

This Church shall be evangelistically missionary in spirit, extending the Gospel through our organized religious channels to the entire world.

It shall promote and maintain the teaching and doctrines known and designated as those of the Missionary Baptist Denomination.

It shall exist to provide regular opportunities for public worship, to sustain the ordinances, doctrines, and ethics set up in the New Testament for the Church of our Lord. Jesus Christ, and to channel its offering to support the objectives of the Kingdom of God.

 

In order to carry out the purpose set forth above, the Church will have full power and authority to purchase, leave ans acquire by gift, devise or bequest and to hold, mortgage, convey and dispose of all kinds of property, both real and personal, provided the title be vested in the Church Trustees as hereinafter set forth.

 

CHURCH ORDINANCE

The Ordinance of the Church shall be Baptism and the Lord’s Supper.

1. Baptism. To be recognized by the Church and meet the following:

A. Repentance of Faith shall precede the candidate’s baptism.

B. Baptism shall be by immersion.

C. Baptism shall be administered by the Pastor or by the authority of the Church.

D. Baptism shall be for the purpose of showing for the candidate’s identification with Christ in his death, burial, and resurrection.

2. The Lord’s Supper (communion): A practice of our Christian worship. It symbolizes the body and blood Christ offered as a continual sacrifice for sins of mankind.

 

A. The Lord’s Supper shall be recognize as the Church ordinance and shall be open to all members.

B. The elements used in the Supper shall be bread and wine.

C. The Lord’s Supper shall be observed every first Sunday of the month.

 

ARTICLE III

 

MEMBERSHIP

SECTION 1.GENERAL

The membership of this Church shall be composed of individuals professing faith in the Lord Jesus Christ who have been baptisted by immersion; have adopted the Church Covenant. Articles of Faith and Constitution and Bylaws of this Church; and who have been received into membership by vote of the Church. The membership shall be the ultimate supreme governing body of the Church.

SECTION II. CANDIDACY

Any person may offer himself as a candidate for membership in this Church. He/she shall be presented to the Church at any regular worship service or Church Conference for membership:

1. By profession of faith and for baptism according to the policies of this Church

2. By letter or promise of a letter of recommendation from another Church.

3. By restoration (Christian experience) upon a statement of prior conversion experience and baptism when a letter is not available.

SECTION III. NEW MEMBERS

New members shall be expected to participate in the new members’ orientation program.

SECTION IV. VOTING

 

1. The members of Rock Hill Missionary Baptist Church shall be divided in two classifications:

(a) Active Member- An active member is any member who supports the Church by his/her participation in Church activities, attendance, and with his/her gift(monies, time, talent, tithes, and offering). The Church acknowledges active membership of the sick, the elderly and its senior citizens. Elderly members, the sick and shut-in who are under financial strain or who have minimum fixed income shall be exempt from financial obligations at the request of the said member and may be classified as an active member.

(b) Inactive Member- An inactive member is any member who fails to support the Church by his/her participation in Church activities, attendance, or with his/her gifts for one year. Said members shall be called to the attention of the Board of Deacons and the Pastor.

2. The Secretary of the Church, in conjunction with the Board of Deacons of the Church, shall at all times, keep a current roll of member of the Church who are ineligible to add and not entitled to vote at the elections and on other matters and issues which come before the Church Conference.

3. Only active members present at any meeting of a Church Conference, regular or specially called, are eligible and entitled to vote in elections and on other matters and issues which come before it. Inactive members are ineligible to and not entitled to vote at the election and on other matters and issues which come before the Church Conference.

SECTION V. TERMINATION

Membership shall be terminated by:

1. Dismission to another Church.

(A letter to unite with another Church may be issued upon request by the member or by the Church which the member plans to join. Such an application must be passed on by the Church Conference.)

2. Exclusion by action of the Church. When a member of the Church is disruptive of Church services or meeting, such member’s membership in the Church may be terminated by the Church upon the recommendation of the Pastor and/.or the Board of Deacons.

The Church, after due notice, following every reasonable measure to assist a troubled member and after every possible kindly effort to make such action unnecessary, may upon a majority vote of members present at a Church Conference terminate the membership of a person in this body for reasons considered sufficient to warrant such action and upon the recommendation of the Pastor and/or Board of Deacons.

Any person whose membership has been terminated for any condition which has made it necessary for the Church to exclude him may upon his request be restored to membership by vote of the Church upon evidence of his repentance and reformation and upon the recommendation of the Pastor.

3. Death.

4. Withdrawal of Membership: The Church may withdraw membership from one who has absentees from the service thirty (30) days (first letter) and in sixty (60) days . After a member has been absent from the service of the Church for a period of 90 days.

 

ARTICLE IV

 

MEETING

Section I. Regular Worship

The Church shall meet each Sunday morning (Sunday evening ) and Wednesday evening for preaching , instruction, evangelism, and for the worship of Almighty God. These meeting will be open to the entire membership of the Churchwill be for all people and will be conducted under the direction of the Pastor.

Section II. Special Services

Revival services and any other Church meeting which will be essential to the promotion of the purposes (objectives) of the church shall be placed on the Church calendar.

Section III. Regular Business Meeting

Regular business meeting (Church conference) shall be held

Section IV. Special Business Meeting

The Pastor may call special business meeting to consider matters of significant nature. A one-week notice of the subject, sate, time and location must be given for

 

the specially called business meeting unless extreme urgency or situations render such notice impractical.

Section V. Quorum

Quorum at any regular meeting or any specially called meeting of the Church Conference shall be a simple majority of the active members of the Church at that time who present at such meeting. An affirmative vote of a simple majority of the active members present ar any such properly called meeting of the Church Conference with a carom present shall be the official action taken by the church on any matter brought before it and so voted upon, except for the hiring and termination of the Pastor.

Section VI. Parliamentary Rules

Roberts Rules of Order, Revised, is the authority for parliamentary rule of procedure for all business meeting of the Church.

ARTICLE V

 

OFFICERS

 

The officers of this Church shall be the Pastor, and other needed vocational leadership positions, such as Deacons, Trustees, Secretary, Assistant Secretary, Treasurer, Financial Secretary and Assistant Financial Secretary, Other such officers, as shall be required to do the work of the Church in any of its departments or organizations, shall be appointed by the Pastor and duly elected by the Church. All such officers shall be active members in good standing at the time of his/her election except that the Pastor may or may not be a member.

 

Section I. Tenure of Office

Except for the Pastor, tenure of office for officers of departments, auxiliaries and board shall be for three(3) consecutive years with election each year. After three (3) consecutive years, an officer call refill that position only after one (1) year out of that office. After a year out of that position, he/she is eligible to serve another three-year (3) tenure, if elected annually. However, each such officer shall serve in his or her respective office until his or her replacement is elected.

ARTICLE VI

 

ELECTION, DUTIES, TENURE AND BENEFITS OF CHURCH OFFICERS

 

A..PASTOR

SECTION I. CALL

1. The Nominee for Pastor shall be a Minister of the Gospel, whose Christian character and qualifications fit him for the office.

2. The Call of the Pastor shall take place at a meeting especially set for that purpose and about which at least two (2) weeks notification has been given to the membership. The section shall be restricted to Candidates recommended by the Pulpit Committee. The Pulpit Committee shall be recommended by the Deacons and approved by the Church.

3. Election shall be by a standing vote or by ballot and with the quorum as defined in this Constitution and Bylaws. In order to be elected as Pastor, he must receive at least two-third (2/3) affirmative vote by the members st such meeting. In the event the Nominee recommended by the Pulpit Committee fails to receive at least two-third (2/3) affirmative vote, the Pulpit Committee shall seek out another Nominee, and the meeting at which the vote was taken shall be adjourned without debate.

4. The Pastor shall be called for an indefinite period of time. His office shall not be up for yearly re-election; however, an annual evaluation shall be held.

5. The Pastor’s termination shall occur upon his own request or at tje request of a bona fide quorum of the Church Membership. The termination period shall consist of ninety days(90). In order to involuntary terminate the Pastor, iw will require a three-fourth vote to do so by the membership at a duly called meeting with a quorum present.

SECTION II. DUTIES OF THE PASTOR

The Pastor:

(1) is the Official Moderator of all Church Meetings;

(2) is the ex-officio member of all boards, organizations, departments and committees of the church;

(3) is responsible for leading the church to functions as a New Testament Church;

(4) shall lead the Congregation, the Organizations, and the Church Staff to perform their tasks;

(5) shall Minister to the Spiritual needs of the members of the congregation, and through prayer and study, under the inspiration of the Holy Spirit, render effective preaching;

(6) shall lead the Church in performing its tasks; and to govern by the principles set forth in Timothy 3:1-7 and Titus 1:6-9

(7) shall lead the Church to engage in a fellowship of worship, witness, education, ministry, and application;

(8) shall proclaim the gospel to believers and unbelievers;

(9) shall care for the general welfare of members of the Church and for others as he deems necessary and devote his full time to his endeavors.

(10) shall visit the sick and shut-in members of the Church.

SECTION III. BENEFITS

1. From the beginning of his term in office, the Pastor of the Church shall be given one week of paid vacation for each year of service; accumulative up to a maximum of four weeks per year. The week(s) or month that he takes the vacation shall be of his own choosing, but must be mutually agreed upon with the Deacon Board. He shall receive a purse for the vacation, which shall be an amount recommended by the Board of Deacons and approved by the church.

2. An annual review of the Pastor’s salary should be made by the Board of Deacons in keeping with the cost of living index. Social security payments, sick benefits, medical insurance, family welfare, retirement, and other considerations, which shall be recommended annually by the Budget -Finance Committee and approved by the Church.

 

 

B. DEACONS

SECTION I. ELECTION AND QUALIFICATIONS

1. The Pastor of Rock Hill Missionary Baptist Church will nominate qualified members for the deaconship to be elected by the church membership.

2. The Deacon shall be elected from among these members who have proven themselves to have scriptural qualifications according to Timothy 3: 1-7 and Act 6: 1-6 and by a majority vote of the membership present at a regular or special conference meeting

3. There shall be minimum of five (5) and no more that twenty-five (25) Deacons at one time.

SECTION II. DUTIES

1. Deacons shall at all times regard themselves as servants of the Church.

2. The deacons shall , along with the Pastor, and as the Holy Spirit may direct, consider to make recommendations to the Church-body in all matters pertaining to its work and progress, including the discipline of the Church membership.

3. The Deacons shall assist the Pastor in the observance and administration of the ordinance of the Church. (Holy Communion and Baptism)

4. The Pastor or the Chairman of the Deacon Board shall call the Deacons into special session whenever a need arises.

5. Deacons shall be eligible to serve on the budget Committee.

6. A deacon shall act as moderator for a business meeting in the absent of the Pastor.

7. A Deacon shall make provisions for midweek prayer services in the absence of the Pastor.

8. To share with the Pastor in the Spiritual oversight of the Church.

 SECTION III. TENURE OF OFFICE OF DEACONS

1. The tenure of office for each Deacon will continue as long as his service is satisifactory to the end that he works in harmony with the Pastor, Board of Deacons, and congregation.

2. Should a Deacon retire from active duty, he shall retain his title of Deacon and may be called upon for service by the Church at any time.

3. A deacon shall not hold the office of Deacon and Trustee at the same time.

SECTION IV. OFFICERS

The Board of Deacons shall consist of the following officers:

a. Chairman

b. Vice -Chairman

c. Recording Secretary

 

C. TRUSTEES

 SECTION 1. ELECTION

1. Trustees shall be recommended to the Church Conference by the Pastor and shall be approved by the Church Membership.

2. Trustees shall be elected for a three-year term. Having served as a trustee during a previous term will not disqualify a member for reelection. Each Trustee will hold office until his/her successor is duly elected by the Church Conference.

3. There shall be two Trustee position eligible for re-election every three years by establishing a rotation system.

4. Position spots for re-election shall be selected by slots- two slots every other year by selection until the rotation system is established.

SECTION II. DUTIES

1. The Trustees shall execute all contracts, deeds, mortgage or other instruments when authorized to do so by the Church in Conference.

2. The Trustees shall have power to buy, sell, mortgage, lease or transfer any property belonging to the Church only with the specific vote of the Church Membership authorizing each action.

SECTION III. OFFICERS

The Trustees shall maintain the following officers:

a. Chairman

b. Vice-Chairman

c. Secretary

 

D. SECRETARY

SECTION I. ELECTION

Upon recommendation of the Pastor, the Church shall annually elect the Secretary of the Church.

SECTION II. DUTIES

1. The Secretary shall be present or represented at all Church business meeting and make and maintain a written record of actions and activities of such meeting.

2. The Secretary shall issue letters of dismission as authorize by the Church and shall preserve all papers, valuable records, and letters that belong to the Church in an appropriate place in the Church office.

3. The Secretary shall keep accurate records of all Church Business transactions.

4. The Secretary in cooperation with the Church Secretary, shall keep an accurate roll of the Church membership; the dates and the methods of admission and dismissal; change in name; status of each member; correct mailing address; and other pertinent information about each member.

5. All books and records kept by the Secretary shall be the property of the Church and kept on the premises of the Church and properly secured. The Pastor and Deacons shall have access to said Books and Records at all times.

6. The Secretary, or his or her designee, shall read the announcement during the Sunday Morning Service.

SECTION III. BENEFITS

1. After having worked for one full year the Secretary is eligible for one (1) week paid vacation.

2. The Secretary’s salary shall be set by the Pastor and the Board of Deacons and must be approved by the membership.

E. ASSISTANT SECRETARY

 

SECTION 1. ELECTION

Upon recommendation of the Pastor, the Church membership shall annually elect an Assistant Secretary.

SECTION II. DUTIES

1. The Assistant Secretary shall act in the absence of the Secretary and shall in the absence of the Secretary have the same duties of the Secretary.

2. The Assistant Secretary shall receive a salary as set by the Pastor and the Board of Deacons and approved by the Church Membership.

F. TREASURER

SECTION 1. ELECTION

Upon the recommendation of the Pastor, the Church membership shall annually elect a Treasurer.

SECTION II. DUTIES

1. The Treasurer shall maintain a record of the receipts and disbursement of funds belonging to the Church. The Treasurer shall regularly meet with the Chairman of Finance Committee to determine at all times the status of all funds belonging to the Church. The Treasurer, along with Chairman of the Finance Committee, shall give financial reports to the Church membership at regular Church membership meeting or at specially called meeting of the Church membership.

 

2. All financial transactions of the Church shall be accurately recorded and records kept and maintained by the Treasurer. All Books and records kept by the property of the Church.

 

3. The Treasurer shall be an ex-officio member of the Finance Committee and Budget Committee of the Church.

 

4. The Treasurer, along with the Chairman of the Finance Committee, shall at all times, make the book and records of the Church’s finance available to the Pastor and Board of Deacons.

 

G. FINANCIAL SECRETARY

SECTION I. ELECTION

Upon recommendation of the Pastor, The Church membership shall annually elect and hire a Financial Secretary.

SECTION II. DUTIES OF THE FINANCIAL SECRETARY

1. Work with the Finance Committee and Budget Committee to prepare a yearly budget.

2. Suggest ways and means to raise finances to meet this budget.

3. Watch the Church’s spending periodically. (Keep spending within the budget)

4. Interpret the budget.

5. Give opinions about emergency spending.

6. Suggest depositories for funds.

7. Suggest a balance between saving and checking accounts.

8. When authorized to do so, open and maintain checking and other bank account(s) on behalf of the Church and draw and make checks on the checking accounts to the Church.

9. Keep accurate records of the receipts, deposits and disbursements of all funds belonging to the Church.

10. Make deposits of funds belonging to the Church into the Church’s banking accounts(s).

11. Develop a system that in order for the Finance Secretary to draw or make a check on the bank account(s) of the Church, a written requisition therefor is required to be made to the Finance Secretary, giving the date, the amount, the purpose thereof and the name of the payee of sais check. Such requisition shall be kept by the Finance Secretary as part of the records of the Church.

12. Shall be bonded in any amount determined by the Pastor and Board of Deacons and approved by the Church.

13. Shall meet on a regular basis with the Church Treasurer and Finance Committee and keep the Church Treasurer informed of the detailed status of all banks account of the Church.

14. Shall, along with the Church Treasurer, make detailed written reports of the receipts and disbursement of Church Funds and status thereof at all regular Church meetings. Specially call church meetings when requested to do so by the Pastor or Board of Deacons.

15. Shall always make all of the financial records of the Church available to the Pastor and Board of Deacons when requested to do so.

16. Shall be a member of the Budget Committee and Finance Committee.

17. Shall immediately report to the Pastor and Board of Deacons any and all apparent irregular or improper transaction dealing with Church funds.

18. Shall authorize a criminal record check on him or her to be preformed for the benefit of the Church.

19. Shall be compensated at a rate and amount determined by the Pastor and Board of Deacons and approved by the Church.

20. May be terminated at any time by the Pastor and Board Deacons with or without cause.

 21. Shall cause the financial records of the Church to be audited annually in January of each year following the period ending December 30 of the preceding year. Said audit shall be preformed by a reputable certified public accountant who has been recommended by the Pastor and Board of Deacons and approved by the Church membership.

  

H. FINANCE CHAIRMAN

 

SECTION I. ELECTION

1. Upon recommendation of the Pastor and Officers, the Church shall annually elect a Finance Chairman.

SECTION II. DUTIES

1. Work with the Finance Committee to prepare a yearly budget.

2. Suggest ways and means to raise finance to meet this budget.

3. Watch the Church’s spending periodically. (Keep spending within the budget.)

4. Interpret the budget.

5. Give opinions about emergency spending.

6. Suggest depositories for funds.

7. Suggest a balance between saving and checking accounts.

 

I. DEPARTMENT LEADERS

 

SECTION I. SUNDAY SCHOOL SUPERINTENDENT

The Superintendent of the Sunday School shall have general oversight of the entire school. He/she administer its affairs in cooperation with , and according to the plans and methods of the Sunday School Board of the General Baptist Convention of North Carolina, subject to the approval of the local church. He/she shall acquaint him/her self with the best methods of religious education and endeavor to adopt them in this school. It shall be his/her duty to plan weekly or monthly with the teachers and officers through officers’ and teachers’ meetings, giving advice and receiving suggestion from co-workers. He/she shall see that a full and accurate written report is made of the work of the Sunday School in the regular business meeting of the church.

 

 

 

SECTION II CHURCH TRAINING UNION DIRECTOR

The leader shall become acquainted with the program and methods outlined by the Sunday School Board of the General Baptist State Convention of North Carolina for this organization and shall endeavor to adopt such programs in this Church, subject to the approval of the Church. The leader has the responsibility to see that a full and accurate written repot is given.

SECTION III PRESIDENT OF THE MISSIONARY CIRCLE

The President of the Missionary Circle shall seek to enlist all the youth, young adults, and senior members of the Church in a program of missionary training, giving, and activity according to plans promoted by the Woman’s Baptist Home and Foreign Missionary Convention Auxiliary to the General Baptist State Convention of North Carolina, Inc. He/she shall see that a full and accurate written report is given at the regular business meeting of the Church.

SECTION IV. PIANIST-ORGANIST

The Pianist(s) and or Organist(s) shall play apporpriate Church music for all occasions.

 

ARTICLE VII

 

COMMITTEES

 

SECTION I. STANDING COMMITTEE

The Church shall elect such standing committee as may be deemed necessary to carry out the various phases of the program of the church efficiently and effectively. In any event, the Church shall have at all times the following standing committees; Budget of Finance, Building and Grounds, Pulpit Supply, Library, Benevolence, Christian Education, Youth, Recreation and any other additional committee deemed necessary for the proper function of the Church.

SECTION II TEMPORARY COMMITTEES

The Church upon recommendation of the Pastor and the Board of Officers may elect at any time Committees to preform temporary functions.

 

SECTION III FINANCE COMMITTEE

 

Upon the recommendation of the Pastor and the Board of Deacons, the Church membership shall elect active members to the Finance Committee, The Finance Committee shall consist of no less that three (3) members and or more than seven (7) members.

(A) Officers

The officers of the Finance Committee shall be:

1. Chairman - The Chairman shall preside over the meeting of the Finance Committee.

2. Assistant Chairman - The Assistant Chairman shall preside over the meeting of the Finance Committee in the absence of the Chairman.

3. Finance Secretary - The duties of the Finance Secretary are those of the hereinbefore set out.

4. Recording Secretary - Recording Secretary shall record and maintain in writing all of the minutes of all the meetings of the Finance Committee.

(B) Duties of the Finance Committee

1. To monitor the receipts and disbursement of all funds belonging tot he Church.

2. The Finance Secretary shall make a complete and detailed report of the receipts and disbursements of all Church funds when requested to do so by the Chairman and/or Pastor.

3. To monitor the spending of the Church to determine whether such spending is within the Church’s budget, then to report the same to the Pastor and Deacon Board.

4. To develop ways to make sure the Church receive sufficient funds to meet its projected budget.

5. To notify the Pastor and Deacon Board of any apparent irregularity in the receipt of disbursements of Church funds.

SECTION IV. Budget Committee

There shall be a Budget Committee of the Church. This committee shall consist of not less than five (5) nor more than nine (9) members who shall be elected by the Church membership each year upon the recommendation of the Pastor. Each member of the committee shall so serve until his or her replacement is elected.

(A) Officers

The officers of the BUDGET COMMITTEE shall be:

 

1. CHAIRMAN- The CHAIRMAN shall preside over the meetings of the Committee. He or she shall be responsible for notifying each member when a meeting is to take place.

2. ASSISTANT CHAIRMAN- The ASSISTANT CHAIRMAN shall preside in the absence of the CHAIRMAN.

3. RECORDING SECRETARY- The RECORDING SECRETARY shall record and maintain in writing all of the minutes of the meetings of the Budget Committee and make reports of such meeting to the Pastor, Deacon Board, and Church membership when required to do so.

(B) DutiesThe duties of the BUDGET COMMITTEE are as follows:

1. To develop an annual budget for the Church in November of each year for the year immediately following November.

2. To make a report of the annual budget it developed to the Pastor and then to the Deacon Board for the purpose of modifications, if any, and to make its report of the final draft of the annual church budget to the Church membership as directed by the Pastor.

3. To work and cooperate with the Finance Committee, Finance Secretary, Treasure, Pastor, and Deacon Board to determine whether the Church is operating within or without its annual budget.

Section V. THE BUILDING AND GROUNDS, PULPIT, SUPPLY, LIBRARY, BENEVOLENCE, CHRISTIAN EDUCATION, YOUTH AND RECREATION COMMITTEES.

The Church membership shall elect active members of the Church to the respective committees listed above upon the recommendation by the Pastor. The Pastor and Deacon Board shall appoint such persons elected by the CHURCH as officers of each committee, respectively and describe in writing what the duties are of each respective committee.

 

ARTICLE VII

 

Adoption and Amendments

 

Section I.

These bylaws shall be considered adopted and in immediate effect if and when two-thirds (2/3) of the members present at the business meeting shall vote in favor of same. This vote shall be taken not less than thirty (30) days after formal notice and presentation of the Bylaws to the Church. Notice of such meeting in which the vote is to be taken shall be given at least one week in advance.

Section II.

These Bylaws may be amended, altered, or repealed by a two-thirds (2/3) vote of the members present at any regular business or specially called meeting of the Church, with a quoram; provided such amendment, alteration or repeal shall have been given to the Clerk in writing and the proposed change presented to the Church at least thirty (30) days prior to the time the vote is taken.
